Release and Waiver of Liability an Indemnity Agreement
Blue Rose PRCA Charity Rodeo – Smiles and Spurs Waiver
In consideration for participation in the Blue Rose PRCA Charity Rodeo event “Smiles and Spurs Rodeo”, the
undersigned hereby releases, waives, discharges and covenants not to sue Blue Rose PRCA Charity Rodeo and
Barnes PRCA Rodeo. Sanctioning organization, owners and lessees of the premises from all liability to the
undersigned and any claim or demands therefore on the account of injury to the person or property of, or
resulting in death of the undersigned, whether caused by the negligence of the releasees or otherwise while the
undersigned is on the Blue Rose PRCA Charity Rodeo and Sarpy County Fairgrounds, structures, fences etc. I/we
hereby agree to Indemnify and save and hold harmless the releasees and each of them from any loss, liability,
damage or cost they may incur due to the presence of the undersigned in and around the arena or in any way
competing or observing or participating in the event whether caused by negligence of the releases or otherwise.
The undersigned hereby assumes full responsibility for and risk of bodily harm, death or property damage due to
the negligence of releasees or otherwise while in and around the arena. The undersigned expressly acknowledges
and agrees that the activities are dangerous and involve the risk of serious injury or death and or property damage.
The undersigned further acknowledges and understands that they will be held liable and responsible for any and all
damage to persons, livestock, vehicles, property and/or improvements to property that is caused by them and/or
any persons (including, but not limited to, minors) under their care and control, and that arise out of, or are related
to, the undersigned’s entry into and participation in the Smiles and Spurs Rodeo. The undersigned expressly agrees
that the foregoing release, waiver and indemnity agreement is intended to as broad and inclusive as is permitted
by the laws of the state of Nebraska, and that if any portion thereof is held invalid, it is agreed that the balance
shall, notwithstanding, continue in full legal force and effect.
AGREEMENT TO INDEMNIFY AND HOLD HARMLESS: The undersigned agrees to INDEMNIFY and HOLD HARMLESS
the Released Parties against any and all Claims arising from or related to the undersigned’s entry and participation
in the Spurs and Smiles Rodeo, including, but not limited to, the types of Claims enumerated in this waiver. In
addition, and without limiting the foregoing, the undersigned agrees to INDEMNIFY the Released Parties for any
Claims for injuries to any minors under their care and control and/or his or her parent/guardian, and for any Claims
asserted by, through or under the undersigned, arising from or related to the undersigned’s entry into and
participation in the Activities—including, but not limited to, the types of Claims enumerated in this waiver. As used
herein, “INDEMNIFY” means to agree to assume the Released Parties’ liability in a situation, thereby relieving them
of responsibility, and/or reimbursing the Released Party for Claims asserted against them. I authorize Smiles &
Spurs Rodeo, Blue Rose Charity PRCA Rodeo, and Barnes PRCA Rodeo Company to obtain emergency medical
treatment for the participant if deemed necessary and understand that I am financially responsible for any medical
expenses incurred.
PHOTOGRAPH/INTERVIEW RELEASE AND INDEMNITY AGREEMENT: The undersigned GRANTS PERMISSION to be
PHOTOGRAPHED or INTERVIEWED in connection with the Smiles and Spurs Rodeo. The undersigned understands
that any such photograph or interview may be used by the Released Parties or television, film, video, visual,
graphic or printed media. The undersigned agrees to RELEASE and INDEMNIFY the Released Parties with respect to
any Claims related to the usage of such photographs or interviews by the Released Parties or any media
—including, but not limited to, the types of Claims enumerated in this waiver.
I ACKNOWLEDGE THAT I HAVE READ AND VOLUNTARILY AGREE TO THE RELEASE AND WAVIER OF LIABILITY AND
INDEMNITY AGREEMENT, and further agrees that no oral representations, statements, or inducements apart
from the foregoing written agreement have been made. The undersigned is not a minor and is over the age of 19
years.
